  342.  Contractors built secret man caves in an EPA warehouse, an
  343. employee pretended to work for the CIA to get unlimited
  344. vacations and one worker even spent most of his time on the
  345. clock looking at pornography.

  347.  It appears, however, that a regional office has reached a new
  348. low: Management for Region 8 in Denver, Colo., wrote an email
  349. earlier this year to all staff in the area pleading with them
  350. to stop inappropriate bathroom behavior, including defecating
  351. in the hallway.

  356. confounded with the problem of an unknown individual leaving
  357. feces in public hallways, a regional branch of the Environmental
  358. Protection Agency hired an outside consultant to inform their
  359. employees that pooping in hallways is bad.

  361.  Government Executive got their hands on an email from the
  362. management EPA’s Region 8 in Denver, Colo., in which a supervisor
  363. begged his employees to stop “placing feces in the hallway” and
  364. clogging up toilets with paper towels. While this is, obviously,
  365. a very disgusting matter, the story veers into pretty dumb
  366. territory soon:

  368.  Confounded by what to make of this occurrence, EPA management
  369. “consulted” with workplace violence “national expert” John
  370. Nicoletti, who said that hallway feces is in fact a health and
  371. safety risk. He added the behavior was “very dangerous” and the
  372. individuals responsible would “probably escalate” their actions.
  373.  
  374.  According to his bio, Nicoletti is, indeed, a nationally-recognized
  375. expert on workplace and school violence prevention, with accolades
  376. from the National Science Foundation and numerous chairmanships.
  377. He’s even “a member of NASA’s team for developing analog’s for
  378. training astronauts for long duration missions, such as the
  379. Mars Mission.”

  381.  Why such a distinguished mind was consulted by the EPA to reach
  382. the conclusion that “placing feces in the hallway” is bad, we’ll
  383. never know.

  410. fluorescent light bulbs are considered the norm.
  411. The incandescent light bulbs use more power, but
  412. they are also warmer and serve an important role

  416. things up and then the setting will turn it off to
  417. keep the right temperature,” explained Mireille
  418. Goguen, who works at the centre.

  420.  She said they were caught off-guard by the bulb
  421. ban and they are already running short on
  422. incandescent bulbs. Now they are asking people
  423. to donate 100-watt bulbs.

  425.  “(We will take) as many as possible. If people
  426. have them hanging around we will take them or if
  427. they want to buy them for us it would be much
  428. appreciated,” said Goguen.

  446. conference in front of Rainbow Market on Federal
  447. Boulevard in which they called the proposed ban a

  452. the solution is worse than the so-called problem,”
  453. said Arabo. “It’s a classic case of politicians
  454. attempting to do something for the environment,
  455. in part to appease some environmental groups,
  456. without seeing the bigger picture.”

  458.  The proposed ban would remove plastic bags from
  459. stores while imposing a paper bag tax on customers.
  460. Shoppers would be charged 10 cents for each paper
  461. bag they might need at a store.

  463.  “This ban will have reaching ramifications. It’ll
  464. cost taxpayers – mothers, fathers and brothers –
  465. more money when they go shopping for groceries,”
  466. said Arabo.

  468.  Though the ban is designed to reduce waste and
  469. help the environment, Arabo argued that plastic
  470. bags only make up one-third of one percent of
  471. the waste stream.

  483. in all homes, but obviously didn’t think long about
  484. how to achieve that.

  486.  First the city of Chico had the ban on nuclear weapons,
  487. then wood-burning stoves, then plastic bags. Now
  488. comes a ban on high-flow toilets. And if you think
  489. the city can’t enforce that, then you haven’t met
  490. the toilet police.

  492.  OK, so the title “Toilet Police” probably doesn’t
  493. appear on any city worker’s business card, but
  494. that’s what they are.
  495.  
  496.  But let’s not blame city building inspectors for
  497. an odd law — or even the Chico City Council. For
  498. once, this ridiculous save-the-world concept doesn’t
  499. come from the council, but rather from the busybodies
  500. in the state Legislature. They passed a law that took
  501. effect Jan. 1 that requires water-conserving plumbing
  502. fixtures on any home built before 1994.
  503.  
  504.  How will that be enforced? Well, if a property has
  505. any work done that requires a building permit from
  506. a city or county, that entity’s inspector must verify
  507. that the home has low-flow toilets, showers and faucets.
  508.  
  509.  To make it even more disturbing, the low-flow
  510. inspection doesn’t occur if you’re getting plumbing
  511. work. It occurs if you’re getting any work that requires
  512. a building permit, such as getting a new heater, new
  513. windows or converting a garage into a den. Uh, maybe.
  514.  
  515.  So under the letter of the law, if a homeowner buys
  516. a new water heater or fireplace insert for a couple
  517. hundred dollars, he or she might spend considerably
  518. more than that converting all toilets, faucets and
  519. showerheads to low-flow devices.
  520.  
  521.  City and county building inspectors don’t want to be
  522. toilet police. We can’t imagine them wanting to spend
  523. time checking a person’s toilet when they’re there
  524. to check an air conditioner. They’re taking a loose
  525. interpretation of the law for now, and won’t inspect
  526. toilets during projects like repairs and maintenance
  527. that don’t involve plumbing.
  528.  
  529.  But there’s no guarantee the state, which passed
  530. the law, won’t require cities and counties to enforce
  531. a strict interpretation.
  532.  
  533.  With all the uncertainty, it entices a homeowner to
  534. ignore the government requirement to get a building
  535. permit for minor home improvement projects.
  536.  
  537.  Governments should be concerned if fewer people take
  538. out building permits. It means less revenue for
  539. cash-strapped local governments.
  540.  
  541.  The building industry is concerned that residents
  542. may put off rebuilding and home improvement projects
  543. because they would include this unwanted expense.
  544. With the building industry and contractors finally
  545. showing signs of recovery from the recession, we
  546. don’t want to see new obstacles.
  547.  
  548.  Once again the state passes a goofy law without
  549. thinking about the consequences, since somebody else
  550. has to enforce it. The city and county building
  551. departments urge residents not to be scared off by
  552. the new laws, to call and ask questions. It seems
  553. they are like the rest of us, trying to figure out
  554. how long they can ignore the fools in Sacramento
  555. before they get caught.

  587. fathers fought against. Straight from the UN Agenda
  588. 21’s playbook, SB1 will give power to a county to
  589. form a “Sustainable Communities Investment Authority”
  590. (SCIA). These Authorities have the power of eminent
  591. domain and can confiscate private property to build
  592. “sustainable communities.” The bill essentially paves
  593. the way for the loss of any true private property in
  594. California, resulting in the loss of freedom and
  595. driving down home values. If the Senate passes the
  596. modified bill, only Governor Jerry Brown (D – CA)
  597. will stand in its way of becoming law.

  599.  This means that city and county governments can
  600. create unelected bureaucracies with the power to do
  601. what’s necessary to create “sustainable communities.”
  602. It also means that the definition of “blight” will
  603. change from the original definition of abandoned
  604. and decaying buildings on residential lots to a

  606. bureaucracies need to create sustainable communities.

  608.  Not only would the government be able to use eminent
  609. domain to procure land for public transportation,
  610. it could take private homes within half a mile of
  611. that public transportation in the name of creating
  612. a sustainable community. A private home is not
  613. really private if it could be taken at any time
  614. to create low income, low energy housing.

  616.  According to Lawrence J. McQuillan, “each Authority
  617. will be granted powers to build “Sustainable Communities”
  618. means jamming people into dense, urban centers using
  619. high-density residential housing and high-intensity
  620. retail and commercial buildings near mass transit
  621. corridors. To that end, SB 1 will grant each
  622. Authority unprecedented powers.”

  624.  Eminent domain has gradually grown to be one of the
  625. most oppressive government policies. Since the
  626. SCOTUS’ decision in Kelo v. City of New London,
  627. eminent domain continues to be the enemy of property
  628. owners. Homeowners have lost their homes to private
  629. development projects. People have been paid less for
  630. their land than they originally paid for it. Businesses
  631. have even been forced to sell their buildings to
  632. corporations. It has become perhaps the most clearly
  633. identifiable example of crony capitalism and corruption

  666. set in motion in 2007 by Congress, and later by an
  667. Executive Order issued by President Obama in May of
  668. last year. The regulations will apply to medium and
  669. heavy-duty trucks built in 2014 through 2018, aimed
  670. at reducing annual national fuel consumption by 530
  671. million barrels.

  673.  The new regulations will be aimed at one of three
  674. specific subsets of trucks: combination tractors
  675. (commonly referred to as semi-trucks), heavy-duty
  676. pickup trucks and vans and vocational vehicles.

  678.  Each category will have its own regulations, but
  679. the end goal is to reduce fuel consumption by as
  680. much as 20 percent by 2018, which is the case for

  721. Obama Admitted Plan Would Raise Electricity Rates

  723.  There is some evidence that President Obama has a
  724. deliberate strategy of increasing electricity rates and
  725. destroying the coal industry.

  727.  “Under my plan of a cap-and-trade system, electricity
  728. rates would necessarily skyrocket,” Obama told the editorial
  729. board of The San Francisco Chronicle in 2008. “Even
  730. regardless of what I say about whether coal is good or
  731. bad. Because I’m capping greenhouse gases, coal power
  732. plants, you know, natural gas, you name it — whatever
  733. the plants were, whatever the industry was, they would
  734. have to, retrofit their operations. That will cost money.
  735. They will pass that money on to consumers.”
  736.  
  737.  “So if somebody wants to build a coal-powered plant,
  738. they can; it’s just that it will bankrupt them,” Obama
  739. said, “because they’re going to be charged a huge sum for
  740. all that greenhouse gas that’s being emitted.”
  741.  
  742.  Obama’s prediction about coal plants have been proven
  743. true. As Off The Grid News previously reported, in October
  744. 2013, FirstEnergy Corp announced that it would shut down
  745. two coal-fired powered plants in Pennsylvania because it
  746. said the cost of complying with EPA regulations was too high.
  747.  
  748.  Reuters estimated that coal-burning power plants capable
  749. of generating 15,000 megawatts of electricity have shut
  750. down since Obama took office in 2009. The news service
  751. also estimates that power plants that generate around
  752. 37,000 megawatts of power will close in the next 10
  753. years. One megawatt can provide electricity to up to
  754. about 1,000 homes.

  756. Awfully Expensive Electricity
  757.  
  758.  Those plants will be closing at a time when demand for
  759. electricity is increasing. That will force utilities to
  760. build power plants that burn other fuels such as natural
  761. gas. It will add additional cost to electricity rates at
  762. a time when the rates are already going up dramatically.

  764.  “It could get awfully expensive,” Daniel Simmons of the
  765. Institute for Energy Research told World Net Daily. “Some
  766. people might see their electricity rates double. If there’s
  767. no backup power plants, that means electricity is going to
  768. get awfully expensive when you have shortages around the
  769. country.
  770.  
  771. Another Obama Plan To Raise Your Electric Bill
  772.  
  773.  “We’re talking about dramatically increasing the cost of
  774. electricity all to reduce carbon dioxide emissions. I
  775. think that is the real goal,” Simmons said.

  777.  Another Obama administration plan to reduce greenhouse
  778. emissions, Carbon Capture and Sequestration, or CSS technology,
  779. could raise electricity costs even more, Simmons predicted.
  780. He noted that a an experimental CSS power plant in the
  781. United States will cost an estimated $4.3 billion to build
  782. and the EPA doesn’t know if the technology would work.

  784.  “The technology is awfully expensive because it hasn’t
  785. been tried anywhere, and that’s to try to capture the
  786. carbon dioxide as it comes out after they burn the coal.”
  787. Simmons said of CSS.
  788.  
  789.  CSS involves the use of filters to divert carbon emissions
  790. from the air – and every taxpaying American will pay. The
  791. CSS plants under construction will require $300 million in
  792. taxpayer subsidies.

  795. of the Obama administration’s policy on coal.

  798. to impossible standards,” Manchin said. “Never before has

  854. emissions by banning new coal plants would do little to
  855. curb global warming since developing countries like
  856. China and India will still use coal power.

  859. carbon dioxide emissions limits for new coal plants
  860. which would effectively ban coal power. That is,
  861. unless they use commercially unproven carbon capture
  862. and storage (CCS) technologies. Tighter emission
  863. controls for coal plants are part of Obama’s plan
  864. to fight global warming.
  865.  
  866.  Critics of the administration argue that banning
  867. coal plants won’t curb global warming because
  868. developing countries continue to build coal plants,
  869. frustrating US efforts to lower global carbon emissions.
  870. Obama conceded that fact, but argued that limiting
  871. emissions here will only help the US because other
  872. countries will come to us for the technology once
  873. we’ve developed it.
  874.  
  875.  “And so if we can figure out a carbon-capture mechanism
  876. that is sufficiently advanced and works, then we are
  877. helping ourselves, because the Chinese and the Indians
  878. are going to build some coal plants, and even if we
  879. don’t build another coal plant in this country, there
  880. are going to be a lot of coal plants around the world
  881. that are built,” Obama told the New Yorker.
  882.  
  883.  “And we have a huge investment in trying to figure
  884. out how we can help them do it more cleanly,” he added.
  885.  
  886.  Obama hopes that by requiring new US coal plants to
  887. use CCS technologies, the country could become a world
  888. leader and export the technology abroad when other
  889. nations can afford it. If the US doesn’t lead, Obama
  890. argues, other countries will not follow.

  892.  “And it’s not sufficient for us to just tell them to
  893. stop,” Obama said. “We’re going to have to give them
  894. some help. We’re going to have to take some of our
  895. research and development on things like clean-coal
  896. technology and be able to export it to them or license
  897. it to them… There’s going to be a process where we
  898. help them leapfrog some of the development stages
  899. that we went through.”

  901.  “This is why I’m putting a big priority on our carbon
  902. action plan here. It’s not because I’m ignorant of the
  903. fact that these emerging countries are going to be a
  904. bigger problem than us,” Obama added. “It’s because
  905. it’s very hard for me to get in that conversation if
  906. we’re making no effort. And it’s not an answer for us
  907. to say, ‘Well, since the Chinese and the Indians are
  908. the bigger problem, we might as well not even bother.’”

  910.  Indeed, countries like China and India are set to
  911. ramp up their coal use dramatically. The World Resource
  912. Institute reports that 76 percent of the proposed
  913. coal-fired capacity is in India and China — nearly
  914. 1,200 coal plants have been proposed globally, totaling
  915. more than 1.4 million megawatts of power.
  916.  
  917.  The Chinese greenlit 100 million metric tons of new
  918. coal production capacity last year as part of the
  919. government’s plan to bring 860 million metric tons
  920. of coal production online by 2015.
  921.  
  922.  The US coal industry, however, says CCS is not yet
  923. proven technology as there are no commercial-scale
  924. coal plants in the country that uses the technology.
  925. In fact, when the Environmental Protection Agency
  926. wrote its rule limiting coal plant emissions it only
  927. cited CCS projects that were government funded and
  928. not in operation.
  929.  
  930.  “It is disingenuous to state that the technology is
  931. ‘ready,’” said Charles McConnell, former assistant
  932. secretary of energy in Obama. “Studies have verified
  933. that implementation of [CSS] technology is necessary
  934. to comply with EPA’s proposed [EPA carbon-emissions
  935. limits] regulation and meet the [greenhouse gas]
  936. targets necessary for limiting CO2 emissions to our
  937. atmosphere.”

  939.  “However, commercial [CSS] technology currently is
  940. not available to meet EPA’s proposed rule. The cost
  941. of current CO2 capture technology is much too high
  942. to be commercially viable,” said McConnell, who now
  943. serves as the executive director of the Energy &

  1587. Agency (EPA) admitted that it can’t actually reproduce
  1588. the “science” it has been using for years as the
  1589. justification for its Clean Air Act.

  1591.  I remember very distinctly the attitude on the
  1592. Georgia Tech campus toward the environmental “science”
  1593. department. I’m sure that much of what was studied by
  1594. environmental science majors was legitimate, especially
  1595. as it concerned local phenomena and processes. But
  1596. when it comes to the global aspects of environmental
  1597. science (weather systems, causation, the long-term
  1598. effects of pollution, etc.), it becomes obvious that
  1599. environmental scientists are less reliable than
  1600. weathermen and relying heavily on extremely speculative
  1601. models of explanation.
  1602.  
  1603.  Pollution is defined by concentrations. Nothing that
  1604. is considered a pollutant is necessarily bad intrinsically
  1605. or necessarily. Even toxic elements occur naturally at
  1606. low concentrations. The EPA determines what those
  1607. concentrations are allowed to be in order to still
  1608. be considered “safe.” And recently, the EPA has been
  1609. narrowing those regulations even further, most recently
  1610. in an attempt to force businesses to “go green.” But
  1611. as it turns out, for years, the EPA has created and
  1612. enforced regulations based on data that it pawned off
  1613. as “hard science” that is impossible to reproduce
  1614. independently. It was secret science. Pet science.
  1615. Not hard science:

  1619. years last August after being stonewalled by the EPA

  1746. years are due to excessive agricultural extractions of groundwater
  1747. that flow into the river, which has harmed fish populations and
  1748. the navigability of the river for recreational rafting and boat
  1749. fishing.

  1751.  The Scott River runs 60 miles in Siskiyou County, located along
  1752. the northerly state border with Oregon. The Scott River watershed
  1753. is 800 square miles. About two-thirds is privately owned and a
  1754. third publicly owned.  Forty-five percent is used for forestry,
  1755. 40 percent for grazing, and only 13 percent for cropland. The
  1756. Scott River Groundwater Basin is still the only one in all of
  1757. California that has surface water and groundwater legally defined
  1758. as “interconnected” (Water Code 2500.5).

  1760.  The Scott River watershed was “adjudicated in 1980,” meaning the
  1761. normal court system for water rights settled local disputes. The
  1762. Siskiyou County Superior Court ruled that all groundwater within
  1763. 500 feet of the river was subject to court monitoring and
  1764. restrictions on pumping.

  1771. a government land grab so horrendous even a U.S. Supreme Court justice warned
  1772. it would “put the property rights of every American entirely at the mercy of
  1773. Environmental Protection Agency employees.”

  1775.  The missing word is “navigable.” The Obama administration is proposing a rule
  1776. titled “Definition of ‘Waters of the United States’ Under the Clean Water Act,”
  1777. which would strike “navigable” from American water law and redefine any piece
  1778. of land that is wet at least part of the year, no matter how remote or isolated
  1779. it may be from truly navigable waters, as “waters of the United States,” or
  1780. WOTUS.
  1781.  
  1782.  The proposed rule would provide EPA and the Corps of Engineers (as well as
  1783. litigious environmental groups) with the power to dictate the land-use decisions
  1784. of homeowners, small businesses and local communities throughout the United
  1785. States. There would be virtually no limit to the federal government’s authority
  1786. over private property.
  1787.  
  1788.  The proposed rule has ignited a firestorm of protest. Agricultural and business
  1789. interests, free-market think tanks, state agencies, attorneys general and governors
  1790. have joined the “Ditch the Rule” movement and demanded it be withdrawn.
  1791.  
  1792.  The Obama administration is conducting an aggressive shield campaign to downplay
  1793. the proposed rule’s huge negative impacts and paint critics as opponents of clean
  1794. water, shills for development interests or anything other than concerned citizens.
  1795.  
  1796.  Obama’s own political shills for anti-development interests, such as Organizing
  1797. for Action, Natural Resources Defense Council and Clean Water Action, are marching
  1798. in lockstep with the agencies to discredit any opposition to the rule.
  1799.  
  1800.  But recently, a group of 25 U.S. senators called out the Obama administration for
  1801. misleading Americans on the proposed rule. In a scathing letter to the EPA and the
  1802. Corps, the senators detailed the administration’s deceptions and bias:
  1803.  
  1804. • The Obama administration claims the proposed “Waters of the United States” rule
  1805. responds to prior requests for a Clean Water Act rulemaking. It does not.
  1806.  
  1807. • The Obama administration insinuates that opposition to the proposed rule is
  1808. equivalent to opposition to clean water. It is not.
  1809.  
  1810. • EPA has attempted to delegitimize questions and concerns surrounding the proposed
  1811. rule. Concerns are legitimate.
  1812.  
  1813. • EPA and the Corps have blatantly misrepresented the impacts of increased Clean
  1814. Water Act jurisdiction. The impacts are real.
  1815.  
  1816. • EPA’s social media advocacy in favor of the proposed “Waters of the United States”
  1817. rule prejudices the rulemaking process. It kills debate.
  1818.  
  1819.  Affected parties are more credible in this battle than the administration. The
  1820. American Farm Bureau started the “Ditch the Rule” movement with pictures that showed
  1821. what the EPA and Army Corps of Engineers would regulate if the Waters of the United
  1822. States rule takes effect: “wetlands” that are nothing more than low spots on a farm
  1823. field, the decorative pond of a suburban home or even a vacant lot that the agency
  1824. designates as possessing the requisite wetness.
  1825.  
  1826.  If the farmer fills in low spots or the homeowner builds a child’s playhouse by the
  1827. pond, or a business constructs a new office on the vacant lot or anyone touches any
  1828. bureaucrat-designated “wetland” in any way, the EPA or Corps may order the owners to
  1829. cease activity, restore original conditions and abandon any use of the property.
  1830.  
  1831.  If the owners do not comply, they could be fined up to $75,000 per day—$37,500 for
  1832. violating the rule and another $37,500 for violating the agency’s order. The property
  1833. owner is blocked from going to court until sued by the agency, which could dawdle
  1834. until fines have skyrocketed into the millions.
  1835.  
  1836. That’s no exaggeration.
  1837.  
  1838.  It’s from Supreme Court Justice Samuel Alito’s concurring decision in the 2012 case
  1839. of Michael and Chantell Sackett, an Idaho couple who placed fill material on their
  1840. property to build their dream home and suffered exactly the outrageous treatment
  1841. the justice described.
  1842.  
  1843.  After failing in lower courts, the Sacketts finally won a Supreme Court ruling that
  1844. they had the right to sue the EPA for exceeding the reach of the Clean Water Act. At
  1845. least three other Supreme Court rulings have rejected parts of the administration’s
  1846. interpretation of the Clean Water Act.
  1847.  
  1848.  The Supreme Court trumps the president of the United States, and in this instance
  1849. shares the concerns of the “Senate 25.” But none of the high court’s decisions answer
  1850. the exact question: What is the reach of the Clean Water Act?
  1851.  
  1852.  Therein lies the crux of the WOTUS menace: The reach of the Clean Water Act is
  1853. notoriously unclear, and EPA and the Corps have kept it that way.
  1854.  
  1855.  The Farm Bureau is particularly concerned by EPA’s refusal to answer direct questions
  1856. such as, “Name three things that get wet, like roadside drainages, irrigation ditches,
  1857. and livestock watering ponds, that would not be regulated by WOTUS.” Dead silence. And
  1858. a permit to do anything in a designated “wetland” can cost upwards of $250,000.
  1859.  
  1860.  The National Federation of Independent Businesses asserted in its official comments to
  1861. the EPA, “The CWA is unconstitutionally vague because the regulated community cannot
  1862. readily determine whether a given property is, or is not, a jurisdictional wetland.”
  1863. The uncertainty helps the Obama shield campaign.
  1864.  
  1865.  Two weeks before the Senate 25 called out the EPA, the attorneys general of 11 states
  1866. and the governors of six states sent a similar letter to the EPA and the Corps.
  1867.  
  1868.  “This rule should be withdrawn and replaced with a common-sense alternative that
  1869. respects states’ primary responsibility over lands and waters within their borders
  1870. while also giving land owners clear guidance,” the letter stated.
  1871.  
  1872.  Scott Pruitt, Oklahoma’s attorney general and a leader in drafting the states’ letter,
  1873. told The Daily Signal, “The proposed ‘WOTUS’ rule unlawfully and unconstitutionally
  1874. asserts federal control over local water and land by needlessly replacing state and
  1875. local land-use management with top-down, federal control.”

  2193. scheduled for Wednesday, May 7, Patrick Sullivan, an
  2194. assistant EPA inspector general for investigations, is
  2195. expected to provide compelling evidence of an extraordinary
  2196. abuse of power — even for Barack Obama — by the all but
  2197. unknown EPA Office of Homeland Security.

  2219. is using the “national security” trope to actively prevent

  2224.  Representative Darrell Issa (R-Calif), a frequent foe
  2225. of the Obama administration, is advantageously positioned
  2226. to put the screws to the president in this scandal, as
  2227. well. As chairman of the House Oversight and Government

  2229. in the White House’s secret EPA squelch squad. “It’s
  2230. disturbing that even investigations by this administration’s
  2231. own nonpartisan watchdogs are being blocked by political
  2232. appointees,” Issa said, as quoted by the AP.

  2235. and the formerly unalienable rights of life, liberty, and

  2241.  Two years ago, the Supreme Court handed the EPA (and the
  2242. Obama administration) an unfavorable ruling in the case of
  2243. Sackett v. US, but it’s the events leading up to that high
  2244. court hearing that boil the blood of constitutionalists
  2245. and property owners. As reported by William Jasper, senior
  2246. editor of The New American:

  2248.  How long would your bank account hold out if an agency of
  2249. the federal government were fining you $75,000 per day? A
  2250. couple of hours, maybe — or a few minutes? Not many
  2251. homeowners could handle that kind of crushing financial
  2252. blow. Even a Bill Gates, a Warren Buffett, or a George
  2253. Soros might blanch at such astronomical fines.
  2254.  
  2255.  But that was the potential cost facing Idaho couple Mike
  2256. and Chantelle Sackett ... who ran into the iron fist of
  2257. the Environmental Protection Agency (EPA) when they began
  2258. building their home in 2007 on a two-thirds acre parcel in
  2259. a residential neighborhood of Priest Lake. Like their
  2260. neighbors who had already built homes next door, the
  2261. Sacketts got their permits from the county and began
  2262. laying gravel and preparing the ground for building.
  2263. That’s when the EPA came in and, without hearings or
  2264. notice, declared that the property is “wetlands” and
  2265. ordered the Sacketts to restore it to the EPA bureaucracy’s
  2266. satisfaction.
  2267.  
  2268.  The Sacketts, having good reasons to believe their
  2269. property is not a wetlands, were determined to contest
  2270. the EPA order. However, the EPA denied their request for
  2271. a hearing. They sought judicial relief, but the US Ninth
  2272. Circuit Court of Appeals sided with the EPA, ruling that
  2273. the Sacketts had no right to immediate judicial review
  2274. of the matter. The Ninth Circuit held that the couple
  2275. would first have to go through the EPA’s years-long
  2276. wetlands permit process, which would end up costing the
  2277. property owners many times the value of their land!
  2278.  
  2279.  Basically, a group of unelected and unaccountable federal
  2280. officials has shattered the dreams of the Sackett family,
  2281. robbed them of the due process of law guaranteed to every
  2282. citizen by the Constitution, and charged them $75,000 a
  2283. day for the privilege.
  2284.  
  2285.  The Sacketts understood the enormity of the issue raised
  2286. by their pouring of a little gravel on less than an acre
  2287. of land. Said Mrs. Sackett in the days leading up to the
  2288. Supreme Court decision, “The EPA can come in and turn your
  2289. life upside down. They can make you feel really small and
  2290. insignificant. And they take away from you your sense of
  2291. America.”
  2292.  
  2293.  The EPA is not content to obliterate property rights,
  2294. however. Recent actions taken against the country's last
  2295. lead smelting facility will affect the right to keep and
  2296. bear arms, as well, by substantially impacting the production
  2297. of ammunition. On December 31, 2013, the lead refining plant
  2298. closed for good.
  2299.  
  2300.  The St. Louis Post-Dispatch reported just before the
  2301. shuttering of the plant:
  2302.  
  2303.  About 145 employees of the Doe Run lead smelter [in Herculaneum,
  2304. Missouri] learned they will lose their jobs at the end of
  2305. December because of the plant’s closure, the Doe Run Co.
  2306. said Wednesday. An additional 73 contractor jobs also will
  2307. be eliminated.
  2308.  
  2309.  By forcibly closing this plant, the Obama administration
  2310. took yet another unconstitutional step — one that will
  2311. severely impinge on the nation’s ammunition-manufacturing
  2312. capability.
  2313.  
  2314.  Why would the Doe Run Company, the owners of the Missouri
  2315. lead smelting facility, agree to being run out of business
  2316. by the EPA? One word: extortion.
  2317.  
  2318.  In a document published on its website, the EPA explains
  2319. that in order for Doe Run to continue its operations, the
  2320. company would have to agree to pay “$65 million to correct
  2321. violations of several environmental laws at 10 of its lead
  2322. mining, milling and smelting facilities in southeast Missouri.
  2323. The settlement also requires the company to pay a $7 million
  2324. civil penalty.”
  2325.  
  2326.  In a statement to the press, Doe Run said the fine and the
  2327. required upgrades to its facilities were “too financially
  2328. risky.”
  2329.  
  2330.  In cases such as those of the Sacketts, the Doe Run smelting
  2331. facility, and scores of others nationwide, the EPA’s heavy
  2332. handed, unconstitutional tactics should have been investigated
  2333. and the nearly unbounded power should have been reined in.

  2335.  They carried on without oversight, however, and perhaps
  2336. now we know why.

  2350. over access to a popular northern California beach. The
  2351. case may be the most significant challenge to the state’s
  2352. public access laws.

  2355. Foundation has accused Khosla “of flouting the California
  2356. Coastal Act when he blocked the only road into Martins
  2357. Beach” from the public.

  2360. “Surfrider, in this lawsuit, is asking to protect an
  2361. access right that simply doesn’t exist.” But they were
  2362. denied their motion to prevent Khosla from testifying in

  2364. the trial resumes.

  2366.  As the Chronicle noted, a 1972 “California Coastal Zone
  2367. Conservation Initiative” made the “entire coast public
  2368. property, including beaches below the mean high tide,”

  2373. projects and is a darling of Democratic politicians,” and

  2398. prison fences in intensively-populated ‘people zones’. Panem

  2400. circuses’ – a term derived from Rome and meaning to give the
  2401. people diversions and distractions to hide what is being done
  2402. to them. Exactly what is happening today.

  2404.  The Totalitarian Tiptoes to just such a world are happening
  2405. all around us, although most people can’t see this because
  2406. they don’t connect the dots. People tend to live in their own

  2424. hosted by Maurice Strong, a Canadian oil and business billionaire

  2426. Strong has been a leader of their exploit-the-environment-to-
  2427. scam-the-people programme which is now in full flow. Strong is
  2428. a member of the Club of Rome, the environmental Hidden Hand in
  2429. the Round Table network that includes the Bilderberg Group,
  2430. Trilateral Commission and Council on Foreign Relations.

  2432.  Strong said in support of Agenda 21: ‘Isn’t the only hope for

  2437. booming and he is a director of the Chicago Climate Exchange
  2438. (largest shareholder, Goldman Sachs), which is ‘the world’s
  2439. first and North America’s only legally-binding greenhouse-gas
  2440. emission registry reduction-system for emission sources and
  2441. offset projects in North America and Brazil’. The Exchange was
  2442. established with funding from the Joyce Foundation where Barack
  2443. Obama was once a director. Strong and Al Gore make money through
  2444. the Carbon Exchange and other means from the lies they promote
  2445. about climate change and the solutions they propose. Kate
  2446. Johnston wrote on the Globalresearch.cawebsite: ‘The same men
  2447. that sold us the myth of man-made global warming are the same
  2448. men that sold us the “solution” of a Carbon Tax and Emissions
  2449. Trading Scheme and now they’re profiting off their lucrative
  2450. investments which are based on lies.’ Strong fled to China in
  2451. 2006 after being accused of corruption with respect to the UN
  2452. oil for food program.

  2454.  Climate change propaganda is a No-Problem-Reaction-Solution
  2455. technique to justify Agenda 21 and its stable-mate the Biodiversity
  2456. Treaty. This is an internationally-binding document involving
  2457. nearly 200 countries. The United States signed the treaty, but
  2458. it was not ratified by the Senate after people like ecologist
  2459. and ecosystem scientist Dr. Michael Coffman exposed its true
  2460. consequences and implications. He said that he realized during
  2461. the 1980s and 1990s that the plan was to use the excuse of
  2462. protecting the environment to confiscate half the land of the

  2543. commissioner warned that such behavior could lead to “agri-

  2564.  A recent review carried out by the organization GRAIN revealed that
  2565. small farms produce most of the world's food and are more productively
  2566. efficient than large farms.
  2567.  
  2568.  Facilitated by an appropriate policy framework, small farmers could easily
  2569. feed the global population. However, small farmers are currently squeezed
  2570. onto less than a quarter of the world's farmland. The world is fast losing
  2571. farms and farmers through the concentration of land into the hands of the
  2572. rich and powerful. The report concluded that if nothing is done to reverse
  2573. this trend, the world will lose its capacity to feed itself.
  2574.  
  2575.  One major reason why small farms are disappearing is the rapid growth of
  2576. monoculture plantations. In the last 50 years, 140 million hectares - well
  2577. more than all the farmland in China - have been taken over for soybean,
  2578. oil palm, rapeseed and sugar cane alone. By definition, peasant agriculture
  2579. prioritizes food production for local and national markets as well as for
  2580. farmers' own families, whereas corporations take over scarce fertile land
  2581. and prioritize commodities or export crops for profit and markets far away
  2582. that cater for the needs of the affluent.
  2583.  
  2584.  This process impoverishes local communities and brings about food insecurity.
  2585. GRAIN's Camila Montecinos concludes that the concentration of fertile agricultural
  2586. land in fewer and fewer hands is directly related to the increasing number
  2587. of people going hungry every day. While industrial farms have enormous power,
  2588. influence and resources, GRAIN's data review showed that small farms almost
  2589. everywhere outperform big farms in terms of productivity.
  2590.  
  2591.  On the heels of the review by GRAIN is a new report from the policy think
  2592. tank the Oakland Institute which states that the first years of the 21st
  2593. century will be remembered for a global land rush of nearly unprecedented
  2594. scale. An estimated 500 million acres, an area eight times the size of Britain,
  2595. was reported bought or leased across the developing world between 2000 and
  2596. 2011, often at the expense of local food security and land rights.
  2597.  
  2598.  The Oakland Institute indicates how a new generation of institutional investors,
  2599. including hedge funds, private equity, pension funds and university endowments,
  2600. is eager to capitalize on global farmland as a new and highly desirable asset
  2601. class. Financial returns, not food security, are what matter.
  2602.  
  2603.  And this trend is not confined to the much publicized buying up of valuable
  2604. agricultural land in low-income by foreign concerns. The Institute's Executive
  2605. Director, Anuradha Mittal, argues that although media coverage tends to focus
  2606. on land grabs in these countries, there is also a new rush for US farmland.
  2607. With rising interest from investors and surging land prices, giant pension
  2608. funds like TIAA-CREF are committing billions to buy agricultural land.
  2609.  
  2610.  She states that one industry leader estimates that ten billion dollars in
  2611. institutional capital is looking for access to US farmland, but that figure
  2612. could easily rise as investors seek to ride out uncertain financial times by
  2613. placing their money in the perceived safety of agriculture. The US will
  2614. experiences an unprecedented crisis of retiring farmers over the next 20
  2615. years, leading to ample opportunities for these actors to expand their
  2616. holdings as an estimated 400 million acres changes generational hands.
  2617.  
  2618.  Mittal argues that for all their size and ambition, virtually nothing is known
  2619. about these new investors and their business practices. Who do they buy land
  2620. from? What do they grow? How do they manage their properties? She concludes
  2621. that in an industry not known for its transparency, none of these questions
  2622. have a satisfactory answer.
  2623.  
  2624.  The corporate consolidation of agriculture is being felt just as strongly in
  2625. Iowa and California as it is in the Philippines and Mozambique. Mittal notes
  2626. that some of the most powerful players involved in these major land acquisitions
  2627. include: UBS Agrivest, a subsidiary of the biggest bank in Switzerland; the
  2628. Hancock Agricultural Investment Group (HAIG), a subsidiary of the biggest
  2629. insurance company in Canada; and the Teacher Annuity Insurance Association
  2630. College Retirement Equities Fund (TIAA-CREF), one of the largest pension funds
  2631. in the world.
  2632.  
  2633.  Mittal argues that this is crucial to look at the motives and practices of
  2634. these major players because although institutional investors only currently
  2635. own an apparently tiny one percent of all US farmland and farmers are still
  2636. the biggest buyers of farmland across the country, the writing is on the wall
  2637. in terms of the long-term trends that threaten US agriculture.
  2638.  
  2639.  Investors believe that there is roughly 1.8 trillion dollars' worth of farmland
  2640. across the US. According to the Oakland Institute, of this between 300 and 500
  2641. billion dollars is considered to be of “institutional quality,” a combination
  2642. of factors relating to size, water access, soil quality, and location that
  2643. determine the investment appeal of a property. This makes domestic farmland
  2644. a huge and largely untapped asset class. Some of the biggest actors in the
  2645. financial sector have already sought to exploit this opportunity by making
  2646. equity investments in farmland. Frequently, these buyers enter the market
  2647. with so much capital that their funds are practically limitless compared with
  2648. the resources of most farmers.
  2649.  
  2650.  Anuradha Mittal notes that they have made an impressive foothold and that
  2651. this is the beginning, not the end, of a land rush. Not only is there space
  2652. in the market for institutional investors to expand, but there are also major
  2653. financial incentives for them to do so. She argues that if action is not taken,
  2654. then a perfect storm of global and national trends could converge to permanently
  2655. shift farm ownership from family businesses to institutional investors and other
  2656. consolidated corporate operations.
  2657.  
  2658.  A September 2013 report by the United Nations Conference on Trade and Development
  2659. stated that farming in rich and poor nations alike should shift from monoculture
  2660. towards greater varieties of crops, reduced use of fertilizers and other inputs,
  2661. greater support for small-scale farmers and more locally focused production and
  2662. consumption of food. The report stated that monoculture and industrial farming
  2663. methods are not providing sufficient affordable food where it is needed. The
  2664. system actually causes food poverty, not addresses it, something which people
  2665. like Vandana Shiva have been saying for some time.
  2666.  
  2667.  Numerous high level reports from the UN and development agencies have argued
  2668. in favor of small farmers and agro-ecology. However, the bedrock of food
  2669. production and food security - the small farmer - faces marginalization and
  2670. economic distress. The trends in favor of ‘asset-based’, corporate-dictated
  2671. agriculture do not bode well, especially for low-income (rural-based) countries.
  2672. That type of system does not exist to address food security or support local
  2673. economies. Based on speculation, the ring-fencing of commodities for markets
  2674. and the control of subsidies, prices and inputs, it exists to satisfy shareholders
  2675. and investors elsewhere.

  2684.  The York County Board of Supervisors is threatening the
  2685. livelihood of oyster farmers.  Zoning is a popular way for
  2686. counties to control where and how things are bought and
  2687. sold. Zoning ordinances can often dictate whether people
  2688. can work, live and play in the same neighborhood. The
  2689. details of zoning are excruciatingly complex leaving people
  2690. unable to respond in a timely manner. The enforcement of
  2691. zoning regulations involves heavy fines and/or incarceration.
  2692. In short, zoning has been a terrific way for counties to
  2693. control people’s lives.
  2694.  
  2695.  Such is the story of oyster farmer Anthony Bavuso and his
  2696. family. After years of working corporate and office jobs,
  2697. Bavuso and his wife took a short hiatus from the day-to-day
  2698. drudgery and returned with a new perspective: they wanted to
  2699. become contributors to the economy of raw materials by producing
  2700. something that people needed.
  2701.  
  2702.  Bavuso moved his family back to their home state of Virginia
  2703. with the dream of becoming food producers. Having access to a
  2704. waterfront property, and a background in oyster gardening, it
  2705. made sense to start an oyster farm. Like other types of farming,
  2706. oyster farmers have to manage the growth of their oysters — a
  2707. labor-intensive process requiring a high level of experience.
  2708. An added benefit, for Bavuso, was the knowledge that oysters
  2709. clean the water. As a lifelong Virginian, the health of the
  2710. Chesapeake Bay is never far from his mind. (Oysters eat algae,
  2711. which proliferates in the pollution of the bay, and turn the
  2712. algae into usable protein for humans.)  So the Bavuso family
  2713. started Seaford Oyster Company in Seaford, Virginia.
  2714.  
  2715.  York County maintains a set of zoning ordinances regulating
  2716. various aspects of farming.  There are a list of things that
  2717. are allowed, and if an activity is not on the list, the county
  2718. prohibits it. Penalties include steep fines and possible
  2719. incarceration. Small changes to the zoning ordinances can
  2720. easily disrupt industries and people’s livelihoods.
  2721.  
  2722.  In 2010, Bavuso followed regulatory procedure within his zoning
  2723. district for an oyster farm. He established a lease with the
  2724. Commonwealth of Virginia that gave him the “rights” to the
  2725. section of the bottomland in the Poquoson River adjacent to
  2726. his property. (The bottom lease gives farmers access to
  2727. shellfish only.) Additional regulations and permits involved
  2728. food safety. Wanting to show his interest in producing the
  2729. safest food possible, Bavuso complied with the entire permitting
  2730. process.
  2731.  
  2732.  Prior to starting the farm, the family looked at this list of
  2733. zones and restrictions. In the Bavuso’s zone, farming is “permitted
  2734. by right.” This means for people to farm the land, they need no
  2735. additional land use permits from the county. According to the
  2736. definition of aquaculture in the code, what Bavuso is doing is
  2737. considered part of what is “permitted by right.”
  2738.  
  2739.  By 2011, after more than a year of farming, refining his expertise
  2740. and growing his customer base, Bavuso read in a local newspaper
  2741. that the county was planning on rezoning to remove agriculture
  2742. activities from Bavuso’s “zone.” A “zone” is any area that the
  2743. county designates. Within each zone, the county stipulates what
  2744. particular activities can take place. Once designated, the county
  2745. applies regulations and restrictions. For example, one common
  2746. zoning requirement is that if an area is zoned for residential
  2747. building, there are restrictions and regulations determining
  2748. how from the property line a structure can be built.
  2749.  
  2750.  Bavuso wanted to make sure that he would be grandfathered in and
  2751. that these changes would not affect his farming operation. He
  2752. didn’t know it at the time, but the ordinance was crafted to
  2753. punish a fellow oyster farmer by the name of Greg Garrett. The
  2754. rezoning effort was a actually a political vendetta to punish
  2755. Garrett for supporting a challenger to a currently elected
  2756. member of the York County Board of Supervisors (BOS). Bavuso
  2757. has gotten caught up in that because he does not agree with
  2758. the agenda of the BOS either. And so began what would be at
  2759. least 3 years of limbo for a peaceful man and his family. After
  2760. his vocal opposition, Mr. Bavuso is now is convinced that they
  2761. are attacking him, personally.

  2796. rainwater in three ponds located on his private land, by
  2797. convicting him on nine counts and sentencing him for 30 days

  2832. citizens concerned, says U.S. Rep. Kevin Cramer. “It is certainly
  2833. alarming the EPA would develop these maps in secret and only release
  2834. them after being confronted by members of Congress,” Cramer, a
  2835. Republican, said in a news release accompanying his office’s release
  2836. of the maps. “The EPA has been hiding information which could upset
  2837. the public and jeopardize its massive power grab of unprecedented
  2838. authority over private and public water.”

  2840.  The maps were released by the EPA to the House Science, Space, and
  2841. Technology Committee, on which Cramer serves. One map shows perennial
  2842. bodies of water in blue and intermittent bodies of water in yellow.
  2843. A second regional map including North Dakota, South Dakota, Montana,
  2844. Wyoming, Colorado and Utah uses blue to show each state’s “wetlands
  2845. inventory.” On that map, nearly the entire state of North Dakota is
  2846. in blue. Critics of the proposed rule have suggested the EPA intends
  2847. to use it to expand regulation far beyond permanent bodies of water
  2848. to lands that hold water only some of the time. “It doesn’t take
  2849. much of a leap to conclude these highly detailed maps developed
  2850. with taxpayer funds are for the purpose of enforcing this rule,”
  2851. Cramer said. But EPA officials say the maps have nothing to do with
  2852. the Waters of the US rule.

  2855. proposed rule or any other regulatory purpose,” EPA spokeswoman Liz
  2856. Purchia told Fox News. The EPA claims they have “regulatory authority”
  2857. over “US waters,” but it’s unclear how that “authority” extends to
  2858. non-permanent bodies of water. In New Mexico, one landowner has
  2859. already experienced the federal government attempting to regulate
  2860. wetlands that aren’t always wet. In 2013 a landowner was prohibited
  2861. by federal authorities who cited the Clean Water Act from cleaning
  2862. out a dry creek bed.

  2864.  Ultimately federal authorities backed down after the Pacific Legal
  2865. Foundation filed a lawsuit on behalf of the property owners. But that
  2866. may not happen in North Dakota. “It is a gall darn can of worms opening,”
  2867. Pete Hannebutt, the director of public policy for the North Dakota Farm
  2868. Bureau, says. “They’ve been trying to reinterpret the rules for years,
  2869. and we’ve been jumping up and down saying it’s not right.” Hannebutt is
  2870. concerned about the EPA’s maps. “It could impact everything that we do
  2871. in generally accepted farming practices, including digging a fence post
  2872. hole, including running fence, including growing hay. It could have a
  2873. huge impact on us,” he said. He’s worried EPA’s regulations could be
  2874. so broad as to hinder a farmer’s ability to access his land.

  2886. Technology Committee, released those maps on Wednesday, while firing off
  2887. a letter to EPA Administrator Gina McCarthy voicing concerns over why they
  2888. were created in the first place.

  2890.  “These maps show the EPA’s plan: to control a huge amount of private property
  2891. across the country. Given the astonishing picture they paint, I understand the
  2892. EPA’s desire to minimize the importance of these maps,” he wrote, in the letter
  2893. obtained by FoxNews.com.

  2895.  But an EPA spokeswoman said the maps, from the US Geological Survey and
  2896. Fish and Wildlife Service, do not depict which waters are subject to EPA
  2897. control.

  2901. initially created years ago and subsequently updated.

  2940. existing Clean Air Act to establish a new source performance
  2941. standard (NSPS)—a limit, in plain English—for carbon dioxide

  2945.  The proposed standard is 1,100 pounds of CO2 per megawatt
  2946. hour of electricity produced. Today’s most advanced commercial
  2947. coal power plants emit 1,800 pounds of CO2 per megawatt hour.
  2948. New plants could comply only by installing carbon capture and
  2949. storage (CCS) technology – a capability that can add 80% to
  2950. the cost of building a new coal plant.
  2951.  
  2952.  To make the proposal look reasonable, EPA has to bend reality
  2953. a lot. Under section 111(b) of the Clean Air Act, NSPS are to
  2954. reflect the “best system of emission reduction” that has been
  2955. “adequately demonstrated.” EPA claims CCS is adequately
  2956. demonstrated -- but there are no commercial-scale power
  2957. plants operating anywhere with CCS, and none is being built
  2958. without heavy taxpayer and/or consumer subsidies.

  2960.  In short, a utility that builds a new coal plant with CCS,
  2961. as required by EPA’s ruling, risks going bankrupt. The rule
  2962. is thus an informal ban on investment in new coal power
  2963. generation.

  3006.  The EPA wants to expand the use of two pesticides that
  3007. could be a major threat to America’s bee population, farms
  3008. and the nation’s food supply. That’s the charge being made
  3009. by the Center for Food Safety and beekeepers.
  3010.  
  3011.  The agency is proposing more uses for thiamethoxam,
  3012. apesticide that has been banned in the European Union
  3013. because it is considered a threat to bees. A letter from
  3014. the Center to the Environmental Protection Agency raises
  3015. some serious concerns about thiamethoxam and another
  3016. pesticide, sulfoxaflor.

  3018.  “Peer-reviewed scientific studies have consistently shown
  3019. that these systemic chemicals are highly toxic to honeybees,
  3020. other pollinators and beneficial insects,” the letter
  3021. states. “Pollinator losses represent a serious threat to
  3022. the agricultural industry and food security. Furthermore,
  3023. these systemic pesticides have also been shown to negatively
  3024. impact beneficial insects and contaminate water bodies and
  3025. soil.”

  3029.  Thiamethoxam and sulfoxaflor are neonic or neonicotinoid
  3030. pesticides which studies have tied to bee deaths, as Off
  3031. The Grid News has reported. Last year scientists from Health
  3032. Canada (Canada’s Department of Health) found 70 percent of
  3033. bees that died from colony collapse tested positive for
  3034. neonicotinoids. AHarvard study this year also tied bee
  3035. deaths to neonicotinoids.

  3037.  “They’re taking in something that they will ultimately die
  3038. from, and they’re taking this into the hive and feeding on
  3039. it all winter, then we wonder why we have winter mortality,”
  3040. Madeline Chagnon, an environmental scientist at the University
  3041. of Quebec, said of bees and the pesticides.

  3043.  Chagnon says the pesticides enter the soil when they are
  3044. coated on seeds. The soil then becomes dusty and is stirred
  3045. up during agricultural processes. The dust exposes the bees
  3046. to the pesticides and eventually kills them. Bees can also
  3047. become exposed to the chemicals while pollinating crops.

  3058. building a stock pond on their eight-acre farm.

  3060.  Andy and Katie Johnson built the pond in 2012. They stocked it
  3061. with trout, ducks, and geese.

  3063.  Of course, the government is why we can’t have nice things.
  3064. Naturally, the EPA has found a reason to come around and harass
  3065. the Johnsons and prevent them from enjoying their property.
  3066.  
  3067.  Johnson said the EPA has engaged him in a power play and is
  3068. threatening him with massive civil and criminal penalties over
  3069. the pond, which they claim is actually a “dam.”

  3075.  The agency claims Johnson violated the Clean Water Act by
  3076. building a dam on a creek without a permit from the Army Corps
  3077. of Engineers. Further, the EPA claims that material from his
  3078. pond is being discharged into other waterways. Johnson says he
  3079. built a stock pond — a man-made pond meant to attract wildlife
  3080. — which is exempt from Clean Water Act regulations.
  3081.  
  3082.  Johnson said that his pond is exempt from the law, and he
  3083. followed state regulations in building it. He has an approval
  3084. etter from the Wyoming State Engineer’s Office as proof, which
  3085. states:
  3086.  
  3087.  “Said permit is in good standing and is entitled to be exercised
  3088. exactly as permitted,” says the letter.
  3089.  
  3090.  The agency is threatening to hit the family with up to $75,000 a
  3091. DAY in fines. Johnson said he’s not paying them a cent:
  3092.  
  3093.  “I have not paid them a dime nor will I. I will go bankrupt if I
  3094. have to fighting it. My wife and I built [the pond] together. We
  3095. put our blood, sweat and tears into it. It was our dream.”
  3096.  
  3097.  Of course, the EPA isn’t backing down. They argue that Johnson
  3098. needs to either restore the land or pay the fines. On January 30,
  3099. the agency gave Johnson 30 days to hire a consultant to assess the
  3100. impact of the supposed unauthorized work and to create a restoration
  3101. proposal. That proposal has to be approved by the EPA, of course,
  3102. and it must contain a schedule. All work would have to be completed
  3103. within 60 days of the plan’s approval.
  3104.  
  3105.  Sounds like they are setting him for failure, doesn’t it? Even if
  3106. he DID violate the law and agreed to make things right, would meeting
  3107. those terms even be possible?
  3108.  
  3109.  If Johnson does not comply with those terms, the EPA is going to
  3110. fine him $37,500 per day in civil penalties, along with $37,500 more
  3111. every day for statutory violations.
  3112.  
  3113.  Johnson is fighting back and has gained the support of three Republican
  3114. senators – John Barrasso and Mike Enzi, who both represent Wyoming —
  3115. and Louisiana Sen. David Vitter, Fox News reports:

  3117.  The Republican lawmakers sent a March 12 letter to Nancy Stoner, the
  3118. EPA’s acting assistant administration for water, saying they were
  3119. “troubled” by Johnson’s case and demanding the EPA withdraw the
  3120. compliance order.
  3121.  
  3122.  “Rather than a sober administration of the Clean Water Act, the
  3123. Compliance Order reads like a draconian edict of a heavy-handed
  3124. bureaucracy,” the letter states.
  3125.  
  3126.  The letter also questions the EPA’s claim that Johnson’s pond is
  3127. actually a dam:
  3128.  
  3129.  “Fairness and due process require the EPA base its compliance order
  3130. on more than an assumption,” they wrote. “Instead of treating Mr.
  3131. Johnson as guilty until he proves his innocence by demonstrating his
  3132. entitlement to the Clean Water Act section 404 (f)(1)(C) stock pond
  3133. exemption, EPA should make its case that a dam was built and that the
  3134. Section 404 exemption does not apply.
  3135.  
  3136.  “If the compliance order stands as an example of how EPA intends
  3137. to operate after completing its current ‘waters of the United States’
  3138. rule-making, it should give pause to each and every landowner throughout
  3139. the country.”
  3140.  
  3141.  Johnson said his battle with the EPA is serving as a learning
  3142. experience for his children:
  3143.  
  3144.  “This is showing them that they shouldn’t back down. If you need to
  3145. stand up and fight, you do it.
  3146.  
  3147.  “This goes a lot further than a pond. It’s about a person’s rights. I
  3148. have three little kids. I am not going to roll over and let [the government]
  3149. tell me what I can do on my land. I followed the rules.”
  3150.  
  3151.  The infringement on Johnson’s property rights under the veil of
  3152. protecting the environment is bad enough, but some say that the
  3153. astronomical fines are perhaps an even bigger issue – and may even
  3154. be unconstitutional, as Evan Bernick of The Foundry explains:
  3155.  
  3156.  But the eye-popping aspect of this story is the severity of the
  3157. penalties threatened. It’s absurd to threaten someone with tens of
  3158. thousands of dollars in fines because he or she lacks a permit. And
  3159. it might also be unconstitutional.
  3160.  
  3161.  The Framers of our Constitution recognized that, at a certain point,
  3162. penalties become unconstitutionally disproportionate. The Eighth
  3163. Amendment’s Excessive Fines Clause reflects that understanding. In
  3164. Austin v. U.S. (1993), and again in U.S. v. Bajakajian (1998), the
  3165. U.S. Supreme Court explained that “[t]he Excessive Fines Clause
  3166. limits the government’s power to extract payments, whether in cash
  3167. or in kind, as punishment for some offense,” and held that civil
  3168. sanctions that do not serve solely remedial purposes are subject
  3169. to the Excessive Fines Clause. It is impossible to understand the
  3170. threatened fines as serving a purely remedial purpose—surely,
  3171. repairing any damage that Johnson inflicted would cost less than
  3172. $75,000 a day. But, under the terms of the CWA, he is potentially
  3173. subject to such penalties as a consequence of his failure to obtain
  3174. a permit.
  3175.  
  3176.  This is just another sad case of big government stomping all over
  3177. the little guy. Hopefully the EPA won’t get away with destroying the
  3178. Johnsons’ hard work and are stopped from sending the family into
  3179. financial ruin.

  3197. apparently been busy while old soldiers waited to see a
  3198. doctor, after all. Serving those who served is not necessarily
  3199. a priority, but saving the planet is Job 1. Solar panels and
  3200. windmills can be more important than the touch of a healing
  3201. hand.

  3203.  The department early on set up an Office of Green Management
  3204. Programs designed to “help VA facilities nationwide recognize
  3205. opportunities to green VA, and to reward innovative ‘green’
  3206. practices and efforts by individual facilities and staff within
  3207. the VA.” This sometimes means paying more attention to greening
  3208. the department and saving the polar ice caps than to health care.
  3209.  
  3210.  In the department’s words, it adopted a far more important
  3211. mission to “become more energy efficient and sustainable, focusing
  3212. primarily on renewable energy, energy and water efficiency,
  3213. [carbon-dioxide] emissions reduction, and sustainable buildings.”
  3214.  
  3215.  The green office isn’t merely a desk and telephone tucked away
  3216. in the dark corner of a nondescript government building. It’s a
  3217. substantial undertaking, with all the luxury, bells and whistles
  3218. of a bureaucracy that means business. Eric K. Shinseki, who
  3219. resigned as secretary in the wake of the VA scandal of the sin
  3220. of omission, traveled the country to boast of the green initiative.
  3221. In one instance, he traveled to Massachusetts to flick the switch
  3222. at a half-million-dollar windmill project at the Massachusetts
  3223. National Cemetery. “Nationally,” he said, “VA continues to expand
  3224. its investment in renewable sources of energy to promote our
  3225. nation’s energy independence, save taxpayer dollars, and improve
  3226. care for our veterans and their families.

  3228.  VA facilities have become littered with every scheme to banish
  3229. carbon dioxide short of requiring visitors to hold their breath.
  3230. Calverton National Cemetery spent $742,034 on solar panels. Fort
  3231. Rosecrans National Cemetery spent $787,308. Not to be out-greened,
  3232. the Riverside National Cemetery spent $1.3 million on its solar
  3233. system.
  3234.  
  3235.  At the Phoenix VA Health Care System, where 20 Americans died from
  3236. incompetence and cover-up, the department spent $20 million putting
  3237. solar panels on the hospital roofs. That would have been more than
  3238. enough money to provide the veterans with the health care they deserved.
  3239.  
  3240.  Some administrators won’t be satisfied until every federal building
  3241. bears a green stamp. In military parlance, the VA is practicing
  3242. “mission creep,” the expansion of a project well beyond its intended
  3243. goals. While the rest of the government continues to waste taxpayer
  3244. funds trying to become carbon-dioxide neutral, the VA should be
  3245. spending every available dollar to relieve pain, cure the sick and
  3246. restore the deserving to health. That’s more important than any fad,
  3247. environmental or otherwise.

  3260. claiming authority to bypass the courts and unilaterally garnish
  3261. paychecks of those accused of violating its rules, a power currently
  3262. used by agencies such as the Internal Revenue Service.

  3265. collecting more fines each year and hitting individuals with costly
  3266. penalties for violating environmental rules, including recently
  3267. slapping a $75,000 fine on Wyoming homeowner Andy Johnson for
  3268. building a pond on his rural property.

  3270.  “The EPA has a history of overreaching its authority. It seems
  3271. like once again the EPA is trying to take power it doesn’t have
  3272. away from American citizens,” Sen. John Barrasso, Wyoming Republican,
  3273. said when he learned of the EPA’s wage garnishment scheme.
  3274.  
  3275.  Others questioned why the EPA decided to strengthen its collection
  3276. muscle at this time.
  3277.  
  3278.  Critics said the threat of garnishing wages would be a powerful
  3279. incentive for people to agree to expensive settlements rather than
  3280. fight EPA charges.
  3281.  
  3282.  EPA officials did not respond to repeated questions by The Washington
  3283. Times about why they thought it was necessary to garnish people’s wages.
  3284.  
  3285.  The EPA announced the plan last week in a notice in the Federal
  3286. Register, saying federal law allows it “to garnish non-Federal
  3287. wages to collect delinquent non-tax debts owed the United States
  3288. without first obtaining a court order.”
  3289.  
  3290.  The agency cited authority under the Debt Collection Improvement
  3291. Act of 1996 that centralized federal collection operations under
  3292. the Treasury Department, which oversees garnishments of wages or
  3293. tax refund checks.
  3294.  
  3295.  Under the law, every federal agency has the authority to conduct
  3296. administrative wage garnishment, provided the agency adopts
  3297. approved rules for conducting hearings where debtors can challenge
  3298. the amount of debt or terms of repayment schedule, a Treasury
  3299. official said.
  3300.  
  3301.  Still, the rule would give the EPA sweeping authority to dictate
  3302. how and whether Americans could dispute fines and penalties, even
  3303. as the amount of EPA fines collected from individuals, businesses
  3304. and local governments steadily increase.
  3305.  
  3306.  The amount of fines raked in by the agency has jumped from $96
  3307. million in 2009 to $252 million in 2012, a more than 160 percent
  3308. increase, according to EPA annual reports.
  3309.  
  3310.  Putting the collection powers on a fast track, the agency announced
  3311. it in the Federal Register as a “direct final rule” that would take
  3312. effect automatically Sept. 2, unless the EPA receives adverse public
  3313. comments by Aug. 1.
  3314.  
  3315.  The EPA said it deemed the action as not a “significant regulatory
  3316. action” and therefore not subject to review.
  3317.  
  3318. The negative reactions began almost immediately.
  3319.  
  3320.  In a comment letter submitted to the EPA, the conservative Heritage
  3321. Foundation faulted the rule for giving the government “unbridled
  3322. discretion” in controlling the process for challenging fines and
  3323. wage garnishment, such as dictating the site of a hearing without
  3324. consideration of the time and travel expense placed on the accused
  3325. debtor.
  3326.  
  3327.  The rule allows the EPA to decide whether a debtor gets a chance
  3328. to present a defense and then picks whomever it chooses to serve as
  3329. a hearing officer, even someone not trained as an administrative
  3330. law judge, wrote David S. Addington, group vice president for
  3331. research at The Heritage Foundation.
  3332.  
  3333.  It also puts the burden of proof on the debtor, not the EPA,
  3334. he said.
  3335.  
  3336.  The EPA has been on the front lines of the battle over Mr. Obama’s
  3337. climate change agenda, including issuing proposed rules that would
  3338. require coal-fired power plants to cut carbon dioxide emissions by
  3339. 30 percent over 15 years.

  3341.  Critics say it will cause massive increases in the cost of electricity,
  3342. lead to power shortages and eliminate jobs, while making scant impact

  3697. ~ Executive Committee; Galice Mining District

  3699.  There have been many questions about rumors of a battle brewing between
  3700. the Bureau of Land Management and several miners within the Galice
  3701. Mining District. While we cannot yet divulge any fine details (and
  3702. ultimately must keep legal tactics completely private), at this time,
  3703. we can confirm the following:
  3704.  
  3705.  1. BLM recently (3/18/15) issued two Stop Orders on a mine, citing
  3706. authority under their 3809 regulations, despite the fact that this
  3707. is one of the oldest active claims in the country. The location date
  3708. of this mine is so old that one of the location notices (the legal
  3709. title to the mine) was actually first recorded in the original Galice
  3710. Mining District Recorder’s book in 1876 and then later transcribed
  3711. into the Josephine County Clerk’s records once the county assumed
  3712. recording duties. Under the 1955 Surface Resources Act, claims of
  3713. this age have exclusive surface rights unless the Department of
  3714. Interior utilized a mechanism outlined in that Act to severe those
  3715. surface rights. Demands to BLM to produce evidence of their surface
  3716. authority in accordance to the 1955 Act have thus far garnered only
  3717. “because we say so” answers and numerous stonewalling tactics. The
  3718. Stop Orders came after several months of back and forth maneuvering
  3719. from both sides, and are clearly retaliatory in nature.
  3720.  
  3721.  BLM are in active violation, on multiple counts, of federal Freedom
  3722. of Information Act statutes. (By contrast, certain mine records in the
  3723. possession of the State of Oregon have been provided in a prompt and
  3724. professional fashion when requested). Similar documents secured by
  3725. another miner have appeared to have been “heavily parsed” of key file
  3726. documents, raising suspicion that BLM is either actively suppressing
  3727. the release of documents that could be very damning or has been
  3728. actively destroying documents which they are obligated under Federal
  3729. Law to maintain and provide on request. One of the BLM employees
  3730. suspected of parsing the records in question has apparently left
  3731. BLM in the last few days.
  3732.  
  3733.  3. What few documents have been produced by BLM to date (many of which
  3734. are in no way very legible) have displayed a long history of non-compliance
  3735. with federal and state laws, as well as their own regulations, as well
  3736. as instances of suspected forgery, fraud, extortion of real estate
  3737. and other issues that suggest a well organized conspiracy that divested
  3738. thousands of miners and others of their property rights, which in
  3739. turn has allowed the BLM and the USFS to exercise ruthless control
  3740. over the entire Public Domain of the Far West, including rights of
  3741. ingress and egress.
  3742.  
  3743.  4. A BLM mineral tech involved in this case remarked (4/8/15) to the
  3744. attorney who is handling this case that he is aware that the BLM position
  3745. is not “open and shut” and is proceeding on shaky ground. Ultimately,
  3746. BLM’s attack on the mine is a rolling of dice in the hope that they
  3747. can get their way opposed to anything grounded in reality.
  3748.  
  3749. Where is this all headed?
  3750.  
  3751.  This case is headed in a direction that presents what is probably a
  3752. once-in-a-generation prime opportunity to strike at the heart of the
  3753. very surface management authority of the DOI and USDA and to restore
  3754. the “as patent” rights of every mining claim owner in the United States
  3755. by striking down the actual source of that intrusive authority.
  3756.  
  3757.  Regardless, we intend to take BLM fully to task and will not feel
  3758. sorry for any civil or criminal consequences that may be leveled upon
  3759. any BLM employees who are found to be negligent of wrong doing. We
  3760. are actively pursuing these individuals through a wide range of
  3761. tactics with the intent to reign in these wrong doers.
  3762.  
  3763.  At this early stage, approximately $10,000 and countless hours have
  3764. been expended on research and related fees in regards to this case,
  3765. which could have far reaching benefits to every miner in the country.
  3766. Thus far, this effort has been taken on by several miners who have
  3767. sacrificed their personal funds and their personal time to the cause.
  3768. The claim owners have since retained attorney James Dole, who has
  3769. successfully defeated BLM in court on numerous mining issues.
  3770.  
  3771.  Considerably more work must be done on this case and many more records
  3772. must be obtained to expose this issue on a wider level.

  3782. “BUNDY RANCH” TYPE STANDOFF BREWING IN SOUTHERN OREGON BETWEEN MINERS AND BLM

  3786.  For the past several years, the miners from the Galice Mining District,
  3787. about 3o minutes west of Grants Pass, Oregon, have been arguing over who
  3788. has the rights to the minerals in the ground around Galice Creek. The
  3789. Galice mining district is compiled of a number of claims, owners and
  3790. miners and has been in continuous operation since the early 1870’s,
  3791. which makes it one of the longest running operations in the US. This
  3792. specific operation predates the BLM bureaucracy by many decades in fact.
  3793.  
  3794.  The area in question has produced in excess of 10 million ounces of gold
  3795. since its conception, and geologists estimate that only 10% of the gold
  3796. in the ground has been removed, which makes this area highly sought after
  3797. by any standard. It is said that children find gold with their hands in
  3798. the creeks to this day.
  3799.  
  3800.  BLM has made several attempts to disband the operation through violations
  3801. that claim improper paperwork filing, ruling changes over time, and other
  3802. unsubstantiated claims. The miners of this district have spend tens of
  3803. thousands of dollars to date to fighting the BLM in the courts and other
  3804. avenues. The district has made requests to produce the official rulings
  3805. that show they are in violation which have gone unanswered. They simple
  3806. reason given by the BLM is that “they say so.”
  3807.  
  3808.  Late last week, BLM officials accompanied by Josephine County Sheriff
  3809. deputies issues a cease and desist order to the district without any
  3810. official ruling by the courts. Specifically, the issue is not even
  3811. scheduled to be heard in court until later in the year. The order has
  3812. given the miners until April 25th to remove all equipment, buildings
  3813. and supplies from the mine. Local BLM officials have threatened to burn
  3814. the buildings down if they are not removed by the date.
  3815.  
  3816.  The people in this district have stated that they will fully disobey
  3817. the order as they claim that it is illegal and invalid. A call for
  3818. assistance to the Oath Keeper’s and other State Militia groups has
  3819. been made and there is no intention to leave the area by the deadline.
  3820.  
  3821.  This issue has far reaching implications. The outcome from this issue
  3822. and the court ruling to come will effect all of America. The issue at
  3823. hand is not just about the Galice Miners and the gold in the ground,
  3824. but more about what the government says you can do with the ground
  3825. in your control. These miners have the rights to the minerals in the
  3826. ground and the government wants that changed. What comes next could
  3827. effect every American. What if your backyard has a specific mineral
  3828. that the government values. By any means, can come in and tell you
  3829. that you can not grow your broccoli on your land because it absorbs
  3830. this “special” mineral? The bigger picture would effect farmers.
  3831. What if gold, oil, or something like uranium was found under a
  3832. farmer’s corn crop. Does the government have the right to those
  3833. minerals and have the ability to over ride your use of your own land?
  3834. This issue will have the ability dictate the future use of our public
  3835. and private lands.
